The online store mainly offers cosmetic products, including creams, serums and other facial and skincare products, as well as other goods and services that may be offered on the website.
These General Terms and Conditions constitute an agreement between the Trader and the User regarding the use of the online store and form an integral part of the sales contracts concluded through it.
Before placing an order, the User should review these General Terms and Conditions, as well as the Privacy and Cookie Policy of the online store.
The online store is operated by:

Hereinafter, the company may be referred to as the “Trader”, the “Seller”, “Elysium Beauty”, “we”, “us” or “our”.
For the purposes of these General Terms and Conditions:
The online store may be browsed freely without registration, except for functionalities for which registration is expressly required.
Orders may be placed either through a registered user account or as a guest, where the relevant functionality is available.
The User undertakes to use the Website in good faith, in accordance with applicable law, these General Terms and Conditions, and the intended purpose of the available functionalities.
Use of the Website in a manner that may compromise its security, normal operation, information systems, or the rights of the Trader or third parties is prohibited.
An order that gives rise to an obligation to pay should be placed by a person who has the legal capacity required under applicable law to enter into the relevant contract.
Where a person does not have the necessary independent legal capacity to conclude the relevant contract, the actions should be carried out by or with the consent of their parent, guardian, custodian or other legal representative, where such involvement is required by law.
As a general rule, the Trader does not require the provision of a personal identification number, a copy of an identity card, or another identity document solely for the purpose of using the online store or placing a standard order.
The User may create a personal account by providing the information required by the system.
Upon registration, the User should provide accurate and up-to-date information.
The User is responsible for keeping their login credentials secure and should not disclose their password to third parties.
If unauthorised access is suspected, the User should change their password and, where necessary, notify the Trader.
The online store offers cosmetic products from third-party manufacturers and brands. Elysium Cosmetic Ltd. is not the manufacturer of the products unless expressly stated otherwise for a particular product.
For each product, information regarding its main characteristics is provided insofar as such information is available and applicable, including purpose, quantity, instructions for use, ingredients, manufacturer and safety warnings.
The User should review the information provided on the product page, as well as the information on the packaging and accompanying materials, before use.
Product images are mainly illustrative. Minor visual differences may occur, including due to packaging changes introduced by the manufacturer, display characteristics or updates to product design, provided that such differences do not materially affect the essential characteristics of the product.
In the event of a discrepancy between the information on the Website and mandatory information on the original manufacturer’s packaging regarding ingredients, warnings or instructions for use, the User should follow the current information displayed on the product, unless otherwise provided by law.
The creams, serums and other cosmetic products offered are intended for cosmetic care and do not constitute medicinal products, unless expressly and lawfully stated otherwise for a particular product.
The information provided in the online store regarding cosmetic products does not constitute a medical diagnosis, medical consultation or personalised medical advice.
The User should use the products in accordance with their intended purpose, the instructions for use and the manufacturer’s warnings.
Before use, the User should check the ingredients of the product, particularly in cases of known allergies, sensitivity or individual intolerance to certain ingredients.
If an adverse reaction occurs, use of the product should be discontinued and, where necessary, the User should seek advice from an appropriate medical professional.
These provisions do not limit the Trader’s liability or the Consumer’s statutory rights in relation to non-conforming, defective or unsafe products.
All prices in the online store are stated in euro (EUR).
The prices displayed are final consumer prices and include all applicable taxes, including VAT where applicable.
Unless expressly stated otherwise, the product price does not include delivery costs.
Delivery costs are stated separately before the order is finally placed or are determined in accordance with the current delivery terms displayed on the Website.
The Trader may change product prices for future orders. Such changes do not affect contracts already validly concluded, unless otherwise required by law.
To place an order, the Customer selects the desired products, adds them to the shopping cart, provides the necessary delivery and payment information, selects the available options, and confirms the order using the relevant checkout button.
Before finally submitting the order, the Customer has the opportunity to review the entered information and selected products and correct any errors.
Where the order gives rise to an obligation to pay, the button used to complete the order should clearly and unambiguously indicate that placing the order entails an obligation to pay.
By clicking this button, the Customer places a binding order for the selected products and the sales contract is concluded, except where the order cannot be fulfilled due to a technical error, lack of availability or another objective reason.
After successful placement of the order, an electronic confirmation containing information about the order may be sent to the email address provided.
If the Trader establishes that the order cannot be fulfilled, the Customer will be notified within a reasonable period and any amounts paid in advance for the unfulfilled part of the order will be refunded where applicable.
The Trader makes reasonable efforts to ensure that information regarding products, prices and availability is accurate and up to date.
In the event of an obvious technical, system or typographical error that a reasonable consumer could recognise as an error, the Trader may notify the Customer and offer fulfilment under the correct conditions or cancellation of the affected order.
Where a prepaid order is cancelled for this reason, the amount received will be refunded without undue delay.
The online store may offer the following payment methods:
The specific payment methods available for a particular order are displayed during the ordering process.
For card payments, protected bank card details are processed by the relevant payment service provider. The Trader does not store the full card number, CVV/CVC code or other protected card data.
For bank transfers, the order may be processed after receipt of the payment has been confirmed, where this is indicated during the ordering process.
Deliveries are made within the territory of the Republic of Bulgaria through the courier companies Econt and Speedy.
Depending on the services available at the time of the order, delivery may be made to an address, courier office or parcel locker.
The delivery price is determined in accordance with the current terms displayed in the online store and/or shown during the ordering process.
The usual delivery time is between 2 and 5 business days, unless otherwise stated for a particular product or order.
The stated period may be extended due to objective circumstances, including increased workload of courier operators, public holidays, campaigns involving increased order volumes, adverse weather conditions, transport disruptions, temporary technical problems, or other circumstances outside the Trader’s reasonable control.
In the event of a significant delay, the Trader will make reasonable efforts to inform the Customer, where the relevant information is available.
This provision does not limit any rights of the Consumer regarding delivery periods under applicable law.
Upon receipt of the shipment, we recommend that the Customer inspect the visible condition of the transport packaging and, where permitted by the courier service, the condition and contents of the shipment.
In the event of visible transport damage, damaged transport packaging or another obvious irregularity, we recommend that this is reported in the presence of the courier and, where possible, an appropriate report is drawn up.
The Customer should contact the Trader as soon as possible if transport damage, an incorrectly delivered product or a missing product is identified.
Failure to inspect the shipment upon delivery or the absence of a courier report does not in itself deprive the Consumer of rights granted by mandatory applicable legislation.
Where the Customer qualifies as a consumer within the meaning of the Bulgarian Consumer Protection Act, the Customer has the right to withdraw from the distance contract without giving any reason and without owing a penalty within a period of 14 days, calculated from receipt of the goods by the Consumer or by a third party indicated by the Consumer, other than the carrier, subject to the conditions and exceptions provided by law.
Where several goods ordered in a single order are delivered separately, the withdrawal period begins upon receipt of the last item where the law so provides.
To exercise the right of withdrawal, the Consumer should notify the Trader of the decision to withdraw by means of an unequivocal statement before the expiry of the withdrawal period.
The Consumer may contact the Trader via:
It is recommended that the notification includes the order number, customer name, the product to be returned and contact details.
The Consumer may also use the standard withdrawal form where such form is provided by the Trader, but use of the form is not mandatory.
Pursuant to Article 57, item 5 of the Bulgarian Consumer Protection Act, the right of withdrawal does not apply to the supply of sealed goods which have been unsealed after delivery and which are not suitable for return due to health protection or hygiene reasons.
Given the nature of the goods offered, this exception may apply to certain cosmetic products, including creams, serums and other products for personal cosmetic use, where:
The mere fact that a product is a cosmetic product does not automatically remove the right of withdrawal. The exception applies only where the statutory conditions are met.
This exception does not limit the Consumer’s rights in the event of a defect, lack of conformity with the contract, or other circumstances in which the Seller is liable under law.
After notifying the Trader of the withdrawal, the Consumer should send or hand back the goods within the period provided by law to:
Elysium Cosmetic Ltd.
1 Vasil Petleshkov St.
7000 Ruse
Bulgaria
Before sending the returned goods, we recommend that the Consumer contacts us at info@elysiumbeauty.eu or +359 892 239 989 so that the return can be processed correctly.
Shipments sent to the Trader with cash on delivery are not accepted, as refunds are processed separately in accordance with the procedure described below.
The direct cost of returning the goods following withdrawal is borne by the Consumer, unless the Trader has expressly agreed to bear that cost or the law provides otherwise.
The Consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods, where such liability is provided by law.
This rule does not affect the separate exception for unsealed sealed goods under Article 57, item 5 of the Bulgarian Consumer Protection Act.
Where the right of withdrawal has been validly exercised, the Trader refunds all amounts received from the Consumer, including the cost of standard delivery to the Consumer, within the periods and under the conditions provided by the Bulgarian Consumer Protection Act.
Where the Consumer has chosen a delivery method other than the least expensive standard delivery offered by the Trader, the Trader is not required to refund the additional costs resulting from that choice.
Refunds are generally made using the same means of payment used for the initial transaction, unless the Consumer expressly agrees to another method and does not incur any additional costs as a result.
For orders paid by cash on delivery, or where a refund using the original payment method is technically impracticable and the Consumer agrees, the amount may be refunded to a bank account (IBAN) specified by the Consumer.
For payments made by bank card, the amount may be refunded through the relevant payment system to the payment instrument used, in accordance with the payment service provider’s rules.
Where permitted by law, the Trader may withhold the refund until the goods have been received back or until the Consumer provides evidence that the goods have been sent back, whichever occurs first.
The right of withdrawal from the contract and the right to make a complaint due to lack of conformity are separate rights.
All goods benefit from the applicable statutory guarantee of conformity under the consumer legislation in force.
For consumer goods, the statutory protection in the event of lack of conformity applies for the period provided by law, including the two-year period of liability for lack of conformity where applicable.
Where a lack of conformity is established, the Consumer may exercise the rights provided under applicable law, including bringing the goods into conformity, replacement, price reduction or termination of the contract, where the corresponding statutory conditions are met.
The exercise of these rights is free of charge for the Consumer in cases where the law so provides.
A complaint may be submitted via:
When submitting a complaint, it is recommended that the Consumer provides the order number, the product concerned, the nature of the issue and suitable contact details, and includes photographs where these may assist in reviewing the case.
The requirement to provide reasonable information regarding the complaint does not limit the Consumer’s rights where the purchase and the lack of conformity can be established by other permissible means.
Where, due to the Trader’s fault, a product different from the one ordered is sent, part of the order is missing, or the product is delivered in a condition for which the Trader is responsible, the Customer should contact us within a reasonable period after discovering the issue.
Where the complaint is justified and the law so provides, the necessary costs of bringing the goods into conformity, including applicable transport costs, are borne by the Trader.
The Trader may request photographs or other information reasonably necessary to establish the nature of the issue and arrange an appropriate solution.
The Trader may periodically organise promotional campaigns, provide promo codes, percentage or fixed discounts, gifts with orders, product bundles or free delivery.
The specific terms of each campaign are displayed on the Website or in the relevant promotional communication.
Unless expressly stated otherwise, different promo codes and promotions cannot be combined.
Promo codes may have an expiry date, a minimum order value, restrictions relating to certain products or brands, and other conditions disclosed when the promo code is provided.
The Trader may terminate or amend the future operation of a promotional campaign, provided that this does not affect rights already acquired by consumers and is permitted by law.
Rules governing the announcement of price reductions apply in accordance with the consumer legislation in force.
The Website may offer vouchers for cosmetic or other services provided at a physical salon.
A voucher may contain separate conditions regarding its validity period, the services for which it may be used, appointment booking procedures, the place where the service is provided and other specific conditions.
The specific voucher conditions are indicated at the time of purchase and/or on the voucher itself.
The purchase of a voucher does not guarantee the availability of an appointment on a specific preferred date or time unless expressly agreed otherwise.
Where a voucher is purchased by a consumer through a distance contract, the right of withdrawal and any applicable statutory exceptions are determined according to the nature of the particular contract and applicable law.
Upon request and after the necessary information is provided, the Trader issues invoices to natural persons or legal entities in accordance with applicable legislation.
The Customer is responsible for the accuracy of the billing information provided.
The content of the online store, including texts, graphics, design, structure, logos, images and other materials, may be protected by copyright, trademark rights or other intellectual property rights belonging to the Trader, manufacturers or other rights holders.
Such content may not be copied, reproduced, distributed, published or used for commercial purposes without an appropriate legal basis or permission from the rights holder.
Information regarding the processing of personal data, the use of cookies, analytics and marketing technologies is contained in the Privacy and Cookie Policy of Elysium Beauty published on the Website.
These General Terms and Conditions do not replace the Privacy and Cookie Policy.
The Trader is liable for failure to perform its obligations within the limits provided by applicable law.
Nothing in these General Terms and Conditions should be interpreted as excluding or limiting the rights of the Consumer or the liability of the Trader where such rights or liability cannot be limited by law.
The Trader is not liable for temporary unavailability of the Website where this results from technical maintenance, issues affecting external service providers, force majeure or other circumstances outside its reasonable control, except to the extent otherwise provided by law.
The Trader offers products in compliance with applicable product safety and cosmetics legislation.
The product pages and/or the product, packaging or accompanying documentation contain, where applicable, information regarding product identification, the manufacturer, the responsible person, as well as the necessary warnings and safety information.
Where information is received regarding a product that may pose a risk to health or safety, the Trader takes the actions required under applicable law, including notifying affected customers where necessary.
For communication related to orders, the Trader may use the email address and telephone number provided by the Customer.
Messages necessary for processing and fulfilling an order do not constitute marketing communications.
The conditions governing electronic newsletters, marketing communications and the processing of related personal data are described in the Privacy and Cookie Policy.
In the event of a problem, we recommend that the Customer first contacts us so that an amicable solution can be sought.

The Consumer has the right to submit complaints to the Bulgarian Consumer Protection Commission (CPC) and to use applicable methods of alternative dispute resolution for consumer disputes.
Where a dispute cannot be resolved amicably, it shall be referred to the competent court in accordance with applicable law.
These General Terms and Conditions do not limit the Consumer’s right to refer a matter to a competent supervisory, administrative or judicial authority.
Any matters not expressly governed by these General Terms and Conditions shall be governed by the laws of the Republic of Bulgaria and applicable European Union law.
Where the Consumer has rights arising from mandatory provisions of applicable consumer legislation, these General Terms and Conditions may not be interpreted as restricting such rights.

Any amendments are published on the Website and apply prospectively, unless otherwise required by law.
The General Terms and Conditions in force at the time the contract is concluded apply to the relevant order, unless a subsequent amendment is more favourable to the Consumer or its application is required by law.
